Attorney at law Zlatina Hadzhipanayotova on family law, mediation and the journey from corporate disputes to protecting children's interests
Bold, principled and experienced, lawyer Zlatina Hadzhipanayotova is the professional you want by your side during some of life's most challenging moments – resolving family law matters. Dubbed "the Bulgarian Erin Brockovich" for her successful campaign for legislative change in support of orphans, she is now leading a new fight – against Article 417 of the Civil Procedure Code, which allows enforcement against a debtor without prior court proceedings.
Why did you choose to specialise in family law?
I started out in corporate law. But even the best results failed to bring me satisfaction. Family law works in a completely different way – it involves real lives and children with their own futures at stake. My choice was a return to what matters most: protecting not financial interests, but human beings.
What are the most common family-related legal matters for which clients seek your assistance?
Divorce and child contact arrangements make up over half of my cases. Then come maintenance claims, division of property and inheritance disputes. Recently, an increasing number of parents seek legal recognition of contact arrangements with their children that cannot be obstructed by the other parent.
For my international clients, the main issues are cross-border inheritance disputes, recognition of foreign court judgments, and property matters involving mixed-nationality families. These cases require comparative legal analysis, not merely knowledge of the Bulgarian Family Code.
When is mediation the better solution?
When both parents can still sit down together and present their views without causing scenes or blaming one another. Mediation saves time, money and, most importantly, spares the child a long and painful process.
It does not work where there is violence, manipulation or a desire to punish the other party. In such cases, the court is the solution.
What inspired you to write your book, Let's Take Revenge on Our Children Through Divorce...?
In ten years in practice, I have seen the same thing over and over again: parents weaponising their children. Lawyers making a living from the conflict. Judges writing decisions "in the child's best interests"... Has anyone actually asked the child?

Bulgarian legislation was denying survivor's pensions to thousands of orphaned children – an injustice that was contrary to European standards. I knew the issue myself, as I was a widow with three children in the same situation. I started as a lawyer, working through the law. Changing the status quo required legal work, media pressure and public support. Leading journalists and thousands of ordinary people stood behind me. Millions of Bulgarian voices...
In 2018, after an initial refusal and a long struggle, the parliament unanimously adopted the amendments that secured support for all orphaned children. The media called me "the Bulgarian Erin Brockovich". I received the "Lawyer of the Year 2018" award. Then, in 2025, my book earned me the "Woman Lawyer of the Year 2025" award.
The book continues the same mission, but through a different tool: not laws, but words. The title is ironic. No one consciously seeks to "take revenge" on their child. Yet that is exactly what happens when divorce becomes a battlefield.
What are the most common myths about divorce?
First: "The children will get over it." They do, but at a cost. The trauma manifests years later, in their own relationships with partners.
Second: "You have to win the divorce." There are no winners here. There are two people who lose in different ways, and one child who loses the most.
And third, the most dangerous myth: "Children don't understand." They do understand. They simply lack the words to express it.
How does your book help readers develop a more realistic understanding of this undeniably traumatic process?
The book does not provide legal advice – that is what lawyers are for. It offers something else: knowledge that is otherwise difficult to obtain.
It contains real court documents and real judgments from actual cases, explained in plain language rather than legal jargon. Readers see what truly happens in a courtroom, beyond the illusion of a battle.
The book also dispels some of the most costly myths. For example, that the law labels a parent as "guilty" because of infidelity. It does not. That there are such things as "parental rights": in reality, there are parental responsibilities shared by both parents. That shared parenting means losing control. It means both parents accepting responsibility. That money can buy the outcome of a case. It cannot. It pays only the legal expenses.
There are also monologues: the mother, the father and the child occupying the same stage in parallel. Their different truths collide. And somewhere between them remains the silence of the child, listening and trying not to hear.
Readers can decide for themselves whether the money, the time and the battles are worth it. They make that choice independently, armed with knowledge that was previously inaccessible to them.
I wrote the book not to offer comfort, but to encourage parents to move forward with the understanding that the best solution cannot be delivered by a court. It is born between the two parents when they stop fighting and start thinking about their child.

Защо избрахте да специализирате в областта на семейното право?
Започнах в корпоративното право. Но и най-добрите резултати не ми носеха удовлетворение. Семейното право работи по коренно различен начин – истински животи, деца със съдби. Изборът ми беше връщане към същината: да защитаваш не материален интерес, а жив човек.

Кои са най-често срещаните поводи, свързани със семейните отношения и тяхното законово изражение, по които ви търсят клиентите?
Разводът и режимът на лични отношения с децата са повече от половината от случаите. След това идват издръжката, делбата на имущество и наследствените дела. Напоследък се увеличава броят на родителите, които идват, за да легализират режим на отношения с децата си, който другият родител да не може да саботира.
За чуждестранните ми клиенти основни теми са международни наследствени спорове, признаване на чужди съдебни решения, имотни въпроси на смесени семейства. Дела, които изискват сравнителноправен анализ, а не само български Семеен кодекс.
В кои случаи медиацията е по-доброто решение?
Когато двамата родители все още могат да седнат на една маса и да изложат гледните си точки, без да правят сцени и да се обвиняват един друг. Медиацията спестява време, пари и, най-важното: спасява детето от продължителен и мъчителен процес.
Не работи при насилие, манипулация или желание за наказване на другия. В такива случаи съдът е решението.
Какво ви вдъхнови да напишете книгата си "Да отмъстим на децата си с развод…"?
Десет години в кантората гледам едно и също: родители, които превръщат децата си в оръжия. Адвокати, които се издържат от войната. Съдии, които пишат "в интерес на детето"... А някой попита ли детето?
Българското законодателство отказваше наследствена пенсия на хиляди деца сираци: несправедливост, противоречаща на европейските стандарти. Знаех проблема отвътре: бях вдовица с три деца в същото положение. Започнах като юрист – от законите. Промяната на статуквото изискваше правна работа, медиен натиск и обществена воля едновременно. Водещи журналисти и хиляди обикновени хора ме подкрепиха. Милиони български гласове...
През 2018 г., след първоначален отказ и последвала борба, парламентът единодушно прие промените, които осигуриха помощи за всички деца сираци. Медиите ме нарекоха "българската Ерин Брокович". Получих наградата "Адвокат на 2018 г." А през 2025 г. книгата ми донесе наградата "Жена адвокат на 2025".
Книгата е продължение на същата мисия, но с друг инструмент: не закони, а думи. Заглавието е иронично. Никой не "отмъщава" на детето си съзнателно. Но точно това се случва, когато разводът стане сцена на война.
Кои са най-разпространените митове относно развода?
Първо: "децата ще го преживеят". Преживяват го, да, но на цена. Травмата се вижда години по-късно, в собствените им отношения с партньорите.
Второ: "трябва да спечелиш развода". Няма победители в тази игра. Има две страни, които губят по различен начин, и едно дете, което губи най-много.
И трето, най-опасният мит: "децата не разбират". Разбират. Просто нямат или не им стигат думи да го изкажат.
Как книгата ви помага да си изградим по-реалистична представа за този несъмнено травматичен процес?
Книгата не дава правни съвети – за това има адвокат. Дава нещо друго: знание, което трудно ще получите.
В книгата има истински актове на съда: реални решения по реални дела, обяснени на човешки език, без правен жаргон. Виждате какво наистина се случва в съдебната зала, отвъд илюзията на битката.
Разсейват се митове, които струват най-скъпо. Например, че законът признава "виновен" родител заради изневяра. Не признава. Че съществуват "родителски права": съществуват само родителски отговорности, споделени между двамата родители. Че споделеното родителство значи загуба на контрол. Значи поемане на отговорност от двете страни. Че парите купуват изхода от делото. Не го купуват. Плащате само разноски.
Има и монолози: паралелно тя, той и детето на една и съща сцена. Различните истини на двамата се сблъскват. А някъде между тях остава мълчанието на детето, което слуша и се опитва да не чува.
Читателят сам преценява дали парите, времето и войните си струват. Той прави избора сам, със знанието, което преди това е било недостъпно.
Написах книгата не, за да утешавам, а за да подтикна родителите да продължат напред с разбирането, че най-доброто решение не може да го вземе съдът. То се ражда между тях двамата, когато спрат да воюват и започнат да мислят за детето.
